Territorial Popular Consultation

The Territorial Popular Consultation is a citizen participation mechanism created by Colombian Law in 1994 through which governors and mayors can consult or ask the public about a matter or decision of departmental, municipal, district or local importance. In order to conduct a popular territorial consultation, the governor or mayor must obtain the go-ahead from the Assembly (in the case of the Departments), the Council (in the case of municipalities) and the Local Administrative Board (in the case of localities). Then, the query question, which can only be voted on with a yes or no, is submitted to the corresponding court to decide on its constitutionality. If it is approved, the consultation is carried out in which the people formally pronounce and decide on the matter in question. In Colombia there have been 34 Popular Consultations at the territorial level. Examples of these queries are: Do you agree and approve of the creation of the municipality of El Roble? (El Roble, Sucre); Do you want the municipality of Galapa to be part of the metropolitan area of Barranquilla? (Galapa, Atlantic); Do you agree and approve of the creation of the metropolitan area of Valledupar? (Valledupar - Agustín Codazzi, La Paz, Manaré, Balcón del Cesar and San Diego - Cesar); Do you agree, Yes or No, that the municipality of Duitama acquire the property located at 22nd Street No. 37A-61 where formerly the Ministry of Public Works ? highways division - operated to be the new Transportation Terminal for passengers? (Duitama, Boyacá); Do you want the Farias, Los Tamacos, El Carmen, Torcuatopinto, San Benito Capachino and Copos de Nieve today belonging to the municipality of San Juan del Cesar in the department of La Guajira to be annexed or belong to the municipality of El Molino? (San Juan del Cesar, La Guajira); Do citizens who live in El Paraíso and Sucre want to be part of the municipality of Sucre? (Piedras, Tolima); Do you agree that we should carry out seismic exploration, exploratory drilling, production and transportation of hydrocarbons in the villages of San José, Monserrate Alto, Monserrate La Vega, Guafal del Caja, Bendiciones, Visinaca, Lagunitas, Aguamaco, Zambo, Oso And Jaguito, where the water recharge zone of the municipality of Tauramena is located? (Turamena, Casanare).
